This is the second petition for grant of bail, pending trial, in a criminal case arising from FIR No.284, dated 12.09.2020, registered under Section 22(c) of the NDPS Act, 1985, at Police Station Ellenabad, District Sirsa.
The first petition was dismissed by directing the Forensic Science Labortary, to send its report after analysis of the sample. As per the case of the prosecution, the petitioner along with a coaccused was apprehended with 1200 tablets containing prohibited substance under the NDPS Act.
As per the reply, the petitioner purchased the tablets from Buta Ram and he does not have any criminal antecedents, apart from the present case. The charges are yet to be framed. Although, the police, after completion of investigation, has already submitted its final report. CRM-M-21529-2021 (O&M) is likely to take time. The petitioner has already suffered incarceration for a period nearly 1 year. Accordingly, the petition is allowed and the petitioner is ordered to be released on bail subject to furnishing adequate bail bonds and surety bonds to the satisfaction of the learned Trial Court/Chief Judicial Magistrate/Duty Magistrate, concerned.
All the pending miscellaneous applications, if any, are also disposed of.
