Challenge in the present petition is to order dated 25.01.2019 passed by learned District Judge, Family Court, Ambala, whereby application moved by the petitioners for grant of interim maintenance allowance has been allowed. However, vide the impugned order, the respondent has been directed to pay Rs.20,000/- per month as interim maintenance allowance from the date of passing impugned order i.e. January, 2019 whereas same should have been awarded w.e.f. the date of filing of the petition instead of January, 2019. 2.

Learned counsel for the respondent informs that present petition has been rendered infructuous as the matter stands fully and finally settled between the parties and respondent/husband has paid Rs.40 lakh to the petitioners. It is submitted that even FIR No.54 dated 15.07.2016 registered by petitioner No.1/wife against her husband/respondent herein and one other person, under Sections 406, SUNENA 2024.03.05 18:36 I attest to the accuracy and authenticity of this document

2024:PHHC:028462 498-A and 506 IPC at Women Police Station Ambala, District Ambala, has also been quashed by a Co-ordinate Bench of this Court vide order dated 11.12.2023 passed in CRM-M-4403-2023, on the basis of compromise dated 06.12.2022.

Perusal of order sheets shows that on the last two dates of hearing i.e. 25.03.2022 and 03.11.2022, there was no representation on behalf of the petitioners. Today also, no one appears on behalf of the petitioners.

In view of the above statement made by learned counsel for the respondent, present petition is being disposed of as infructuous. However, in case anything still survives in the matter, the petitioners are granted liberty to move an appropriate application for reviving the present petition within a period of 3 months from today, in accordance with law, if so advised.
