The present appeal pertains to the year 1998. On 21.11.2001 it was noted in the order passed by the Lok Adalat that the sole respondent had died and that necessary steps be taken for impleading the legal representatives of the respondent. From 2001 to 2012 the case was adjourned only to enable the counsel for the appellant to implead the legal representatives of the sole respondent. Vide order dated 09.08.2012 the Lok Adalat sent back the matter to this Court for adjudication. Till date no application has been filed for impleading the legal representatives of the sole respondent. 23 years have elapsed and the counsel for the appellant has not been able to implead the legal representatives of the sole respondent. Today, again, a request for an adjournment has been made, which cannot be acceded to.

In view of the above, this Court is left with no other option but to dismiss the present appeal for non-prosecution. 3.
