Through this petition under Section 439 Cr.P.C., petitionerSatish, has prayed for grant of regular bail in case FIR No. 244 dated 23.03.2017, registered under Sections 307 and 323 read with Section 34 IPC and Section 25 of the Arms Act.

Learned counsel for the petitioner contends that the petitioner was not named in the FIR. His co-accused, namely Dinesh @ DK, has already been granted regular bail by this Court vide order dated 01.08.2017 (Annexure P-3) passed in CRM-M-26829-2017. The role attributed to the petitioner is akin to that of his co-accused Dinesh @ DK and thus, treating the case of the petitioner on the same parity, he be released on bail. The petitioner is in custody since 27.05.2017.

On the other hand, learned State counsel vehemently opposed the submissions made by learned counsel for the petitioner. 4.

Considering the overall circumstances of the case and the fact that co-accused of the petitioner, namely, Dinesh @ DK, whose role is akin to the petitioner has already been granted the concession of regular bail by this Court, the petitioner deserves the concession of regular bail. 6.
Thus, without expressing any opinion on the merits of the case and also that the trial is likely to take time, the instant petition is allowed and the petitioner-Satish is ordered to be released on bail pending trial, subject to his furnishing adequate bail bonds and surety bonds to the satisfaction of trial Court/Duty Magistrate, Hisar.
