MEENAKSHI I. MEHTA, J.(Oral) The petitioner herein has sought the relief of anticipatory/ pre-arrest bail in the criminal case arisen out of the FIR bearing No.0151 dated 27.03.2023 registered at Police Station Pinjore, District Panchkula, under Sections 406, 498-A, 506 and 120-B IPC. 2.

It is worth-while to mention here that vide the order passed by the Co-ordinate Bench on 24.04.2023, the arrest of the petitioner had been stayed subject to his joining the investigation. However, on 18.07.2023, learned State counsel apprised the Court that though the petitioner had joined in the investigation but he did not co-operate in the said proceedings and the dowry articles were yet to be recovered from him. Then, on the YAG DUTT 2023.11.03 16.03 I attest to the accuracy and authenticity of this order/judgement

CRM-M No.19960 of 2023 -22023:PHHC:138556 request as made by his proxy counsel on that day, the petitioner was afforded one more opportunity to join in the investigation proceedings and to do the needful.

Today, learned State counsel, on the instructions from ASI Vikrant from the afore-referred Police Station, again informs the Court that though the petitioner had joined in the investigation but he did not co-operate with the Investigating Agency and the 'Istri-dhan' of the complainant-wife, including the gold jewellery items, has not been got recovered by him.

Keeping in view the above-discussed facts and circumstances, this Court is of the considered opinion that the petitioner does not deserve the relief of anticipatory/pre-arrest bail. Resultantly, the petition in hand stands dismissed accordingly.
