Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 seeking regular bail in FIR No. 698 dated 14.12.2004 under Section 394, 397, 120-B of the Indian Penal Code, 1860 and Section 25 of the Arms Act, 1959, registered at Police Station City Rohtak, District Rohtak. Prosecution story, in brief, is that on 14.12.2004, at about 1.30 P.M., complainant was carrying ` 65,000/- in a bag on a scooter. When the complainant reached a little ahead of sugar mill gate, he was waylaid by two boys. The said boys fired towards the complainant. As a result of this, complainant fell down. Both the boys took away the cash and one bundle of ` 5,000/- fell down. Learned counsel for the petitioner has submitted that the petitioner was innocent and has been falsely involved in this case.

Crl. Misc. No. M-33136 of 2015 -2the petition and has submitted that six more criminal cases are pending against the petitioner. In fact, petitioner was declared a proclaimed offender and he was arrested after nine years. Coaccused of the petitioner, who had faced trial, were convicted and sentenced by the Trial Court.

Keeping in view the submissions made by the learned State counsel, no ground for grant of bail to the petitioner is made out.

Dismissed.
