***** M.M.S. BEDI, J.(Oral) The petitioner is a complainant in two FIRs. One was registered on the allegation that the private respondents had attacked and murdered son of the petitioner. The second FIR was lodged by the petitioner on the allegation that fake records have been prepared in favour of one of the accused persons i.e. respondent No.11.

The petitioner seeks protection of his life and liberty at the hands of respondents No. 5 to 15, who are accused in two FIRs. Reply has been filed by the Deputy Superintendent of Police, Hodal stating therein that the Investigating Officer has procured warrants of arrest against the private respondents who are not residing in their houses and have concealed themselves in order to avoid arrest. On instructions from ASI Babu Ram, learned State counsel has informed that out of 12 accused, 11 stand arrested and 4 have been granted concession of bail and one SATYAWAN 2016.05.23 10:35 I attest to the accuracy and authenticity of this document High Court Chandigarh

CRM-M-33157-2015 -2person has been declared proclaimed offender whereas remaining 7 accused are in custody.

Taking into consideration the nature of the allegations and considering the apprehension raised by the petitioner, I dispose of this petition with a direction that in case of any imminent threat to the petitioner at the hands of the private respondents, it would be open to the petitioner to file representation before the Superintendent of Police, Palwal, who will take into consideration the threat perception and the petitioner may be granted protection at least to enable him to fairly depose in the Court. In case, there is any other apprehension and threat to the life and liberty of the petitioner, any representation submitted on that behalf will be considered expeditiously by the Superintendent of Police, Palwal.
