Petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.0001 dated 01.09.2015 under Sections 498-A,, 328, 323, 506 and 120-B IPC, registered at Police Station Women Police Station, Panchkula District Panchkula.

Notice of motion was issued and learned State counsel as well as learned counsel for the complainant appeared and contested the petition.

CRM No.M-33163 of 2015 -2At the time of arguments, learned counsel for the petitioners as well as learned counsel for respondent No.2 argued that there is matrimonial dispute between the parties, which has already been settled amicably. Learned counsel for respondent No.2 further contended that respondent No.2 has no objection if anticipatory bail is granted to the present petitioners. Otherwise also, the petitioners are parents-in-law of respondent No.2 Preeti. The FIR is not under Section 406 IPC. Nothing is to be recovered from the petitioners. The main allegations are against the husband. The petitioners are not required for any investigation or interrogation purposes.

Keeping in view the facts and circumstances of the case and in view of the compromise between the parties, I find it a fit case where petitioners are entitled to benefit of anticipatory bail. It is ordered that, in the event of arrest, the petitioners be released on anticipatory bail subject to their furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer.
