ARVIND SINGH SANGWAN, J. (Oral) Prayer in this petition is for grant of regular bail to the petitioner under Section 439 of the Code of Criminal Procedure (in short 'Cr.P.C.') in FIR No.29 dated 16.02.2018, for offence punishable under Sections 308, 325, 323, 341 read with Section 34 of the Indian Penal Code, 1860 (in short 'IPC'), registered at Police Station Sangat, District Bathinda.

Counsel for the petitioner has submitted that as per the allegation in the FIR, the petitioner is attributed an injury which is on the non-vital part of the body i.e. on the shoulder of the complainant. It is further submitted that all the 03 accused have been arrested and the petitioner is in custody since 26.02.2018, the investigation is complete and challan has been presented. It is further submitted that the petitioner is not involved in any other case. Counsel for the State, on instructions from HC Mohinder Singh, has submitted that the injury invoking Section 308 IPC is MOHD YAKUB 2018.08.16 17:43 I attest to the accuracy and authenticity of this document Chandigarh

CRM-M No.34124 of 2018 attributed to Jasvir Singh and the petitioner is not involved in any other case and the report under Section 173 Cr.P.C. has been presented. Without commenting anything on merits of the case and considering the fact that the petitioner is in custody since 26.02.2018 and is no more required for further investigation and he is attributed an injury, which is on the non-vital part of the body, this petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail bonds/ surety bonds to the satisfaction of the trial Court/Illaqa Magistrate/Duty Magistrate.
