***** ARCHANA PURI, J. (Oral) The present appeal has been filed by the appellants, thereby seeking enhancement of compensation, awarded by learned Tribunal, on account of death of Dinesh, in a motor vehicular accident, which took place on 23.09.2020.

As observed in the previous order, both the counsel submit that the amicable settlement has reached between the parties and the Insurance Company has agreed to pay a sum of Rs.2,90,000/-, over and above the awarded amount of Rs.17,82,000/-.

In view of the amicable settlement, the Insurance Company, shall pay a sum of Rs.2,90,000/-, over and above the awarded amount. Out of the said amount, an amount of Rs.1,00,000/-, shall be paid to the widow of the deceased, namely, Santosh @ Santosh Kanwar and Rs.50,000/- each, Sonu 2025.11.21 18:04 I attest to the accuracy and authenticity of this document

FAO-2690-2023 shall be paid to the three children, namely, Radhika @ Radhika Kanwar, Nitin Singh Sehekhawat and Tannu @ Tannu Kanwar, who are appellants No.2 to 4 and the residue amount of Rs.40,000/-, shall be paid to the mother of the deceased, namely, Harbai @ Harbai Kanwar. The aforesaid amount be disbursed to the appellants, by way of cheques to the extent aforesaid, in the name of the respective appellants. As such, the requisite enhanced amount i.e. Rs.2,90,000/- be paid by the Insurance Company, to the appellants, within a period of two months from today onwards.

In the eventuality of any default, on the part of the Insurance Company, in making the payment, within a period of two months, it shall be liable to the penal interest @ 6% per annum, till realization. In view of the aforesaid terms, the FAO is allowed being compromised.
