H. S. Madaan, J. (Oral) This is an application praying for issuance of a direction to the trial Court/Illaqa Magistrate/Investigating Officer to direct respondent No.2 - Gurjinder Singh to surrender his passport in the case.

The petitioner has approached this Court straightway without moving the trial Court. The petitioner is relegated to the remedy of approaching the trial Court at the first instance, which shall look into the apprehension of the petitioner with regard to the likelihood of respondent No.2 fleeing the country and then issue necessary direction to such respondent No.2, to surrender his passport in the Court if need be. The application so filed, be decided expeditiously. Disposed of accordingly.
