Petitioner herein seeks issuance of a writ in the nature of mandamus directing the respondents to consider the case of the petitioner for promotion to the post of Lecturer in English/Punjabi. He contends that he is entitled to the same in accordance with Punjab State Education Class-III (School Cadre) Service Rules, 1978 as well as all consequential benefits. 2.

In the circumstances, petitioner submitted a representation dated 02.04.2018 (Annexure P-3) followed by causing a legal notice dated 11.10.2018 (Annexure P-4), but the same have not been adverted till date by the respondents. Hence this petition"!!

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the writ petition is disposed of with a direction to respondent No.3-Director Public Instructions/competent authority to objectively consider the legal notice dated 11.10.2018 (Annexure P-4) and also by keeping in view the contentions stated in the present writ petition by treating it as a supplementary representation and pass a speaking order, in accordance with law.

Let the needful be done within a period of three months from today. In case petitioner is found entitled to the benefit as contended by him, same be accorded to him within 60 days thereafter. 7.

Disposed of in above terms.
