Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioner, Charanjit Kaur, who has been booked for having committed the offences punishable under Sections 313, 315 and 323 read with Section 34, IPC, in a case arising out of FIR No.209, dated 25.08.2014, registered at Police Station, Patran, District Patiala. Learned counsel contends that the charge-sheet has been presented, therefore, it is a fresh ground for filing the second petition before this Court.
I have heard learned counsel for the petitioner and with his able assistance gone through the material available on record.
It is the second petition filed by the petitioner. On 13.08.2015, the earlier petition filed by the petitioner seeking SEEMA RANI 2015.09.29 16:47 I attest the accuracy and authencity of the document
Criminal Misc.No.M-33229 of 2015 [2] the same relief was dismissed as withdrawn by passing the following order:- "Learned counsel for the petitioner prays for withdrawal of the present petition to enable the petitioner to appear before learned Area Judicial Magistrate and seek bail in accordance with law. Dismissed as withdrawn.
In case the petitioner appears before learned Area Judicial Magistrate within 15 days of passing of this order and moves an application for grant of bail, the same shall be disposed of as expeditiously as possible."
There are specific allegations against the petitioner with regard to causing of injury to Karamjit Kaur as a result thereof, six months old pregnancy was terminated. No ground for grant of anticipatory bail to the petitioner is made out.
Dismissed.
