The petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.111 dated 3.8.2016 registered for the offences under Sections 302, 307, 148 and 149 IPC at Police Station Beas, District Amritsar.
Notice of motion to Advocate General, Punjab. Mr. Gaurav Garg Dhuriwala, learned Senior Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioner and learned State counsel and have gone through the record.
Learned State counsel has brought it to my notice that the trial Harpal Singh Parmar 2017.09.15 17:04 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-33249 of 2017 [2] is almost complete and only cross-examination of Investigating Officer remains to be conducted in this case.
Keeping in view the facts and circumstances of this case and the fact that the trial is almost complete and even examination-in-chief of Investigation Officer has already been recorded and only his crossexamination remains to be conducted and further more, the present petitioner, as per prosecution version, has taken active participation in the commission of offence and he was stated to be armed with `Dang' and gave injury to the complainant, I do not find it a fit case where the petitioner is entitled to the benefit of regular bail.
Therefore, finding no merit in this petition, the same is dismissed.
