The petitioners have been summoned as additional accused u/s 319 Cr.P.C. They seek quashing of the proceedings on the basis of compromise.

Counsel for the complainant has put in appearance to state that the matter has been amicably resolved between the petitioners and the complainant, after they were summoned u/s 319 Cr.P.C. The compromise has been placed on record as Annexure P-4.

Without expression of any opinion on merits of the case and taking into consideration inconsistent stands taken by the complainant at different stages, I do not find any ground to quash the proceedings. In case such an approach is adopted, permitting the complainant to change stands on different dates, it will tantamount to playing in the hands of the complainant.

This petition is disposed of with a direction that the personal appearance of the petitioners will be exempted during pendency of the trial subject to any conditions imposed by the trial court, in case such an application is filed by them. The evidence will be recorded in their absence but in presence of the counsel, as per the provisions of Section 273 Cr.P.C.
