******* SURINDER GUPTA, J.(Oral) Present petitions have been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to petitioners in case FIR No.36 dated 18.07.2018 registered for the offence punishable under Section 21 (1) of the Mine and Minerals (Regulations and Development) Act, 1957 , at Police Station Taragarh, District Pathankot. Heard.

Learned State counsel on instructions from ASI Gurmukh Singh submits that petitioners have joined the investigation but the police has only to take into possession driving licences of drivers of vehicles. Learned counsel for petitioners submits that driving licences of petitioners/drivers will be produced before the investigating officer. CRM-M-34233 of 2018 -2In view of submission of learned counsel for petitioners and learned State counsel but without expressing any opinion on the merits of the case, these petitions are allowed and orders dated 13.08.2018 and 10.08.2018 passed in CRM-M-34233-2018 and CRM-M-34569-2018 are made absolute till the presentation of challan, subject to the following terms:- (i) that petitioners shall make themselves available for interrogation by the police as and when required; (ii) that petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against them so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) that petitioners shall not leave India without the prior permission of the Court.

(iv) that petitioners will seek regular bail on the presentation of challan in Court.
