Through the instant petition filed under Section 438 Cr.P.C., the petitioner seeks anticipatory bail in case FIR No.144 dated 28.09.2014 registered under Sections 420, 465, 468, 471, 473 and 120-B of Indian Penal Code, 1860 at Police Station Dasuya, District Hoshiarpur (Annexure P-1).

Counsel for the petitioner has contended that allegation against the petitioner is that he was recruited in the Indian Army on the basis of fake Ration Card and other documents presented by him which showed him to be resident of village Lamin. CRM-M-21465 of 2021 {2} back in the year 2014. He submits that the petitioner has joined the investigation, in pursuance to the interim protection granted by this Court, vide order dated 28.05.2021.

Upon instructions from SI Dilbag Singh, State counsel affirms this fact and submits that the petitioner is no longer required for custodial interrogation as the challan stands presented. In view of the above facts, but without commenting on the merits of the case, the present petition is allowed and the order dated 28.05.2021 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
