The petitioner seeks the concession of regular bail in a case registered at the instance of Jagjit singh alleging that the petitioner along with others attacked Baljinder Singh and Gurdial Singh, besides the complainant, resulting in injuries with sharp edged weapons and blunt weapons.
So far as the petitioner is concerned, he was allegedly armed with an iron rod but no specific injury has been attributed to the petitioner. Counsel for the complainant has intervened to oppose the petition contending that the injured Gurdial Singh has received an injury near the eye and on account of the said injury he remained bed ridden and was not able to speak.
I have heard counsel for the parties. So far as the petitioner is concerned, no doubt he is named in the FIR having accompanied the other co-accused but later portion of the FIR where roles have been attributed, no specific injury has been attributed to the petitioner. In view of the said circumstances, the petitioner can be granted the concession of bail as he has been in custody since 17.6.2014. The petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court, subject to the condition that he will not brow beat the witnesses or tamper with evidence. In case of any such eventuality, it will be open to the complainant/ State to seek cancellation of bail.
