(Oral) The petitioner herein seeks the relief of regular bail in the criminal case arising out of the FIR bearing No.08 dated 25.02.2021 registered at Police Station Jodhan, District Ludhiana, under Sections 307, 326, 324, 325, 341, 148 and 149 IPC with the allegations that he and his co-accused caused injuries to complainant-Jagmohan Singh and also to Sandeep Singh with weapons like sword, iron pipes etc. Reply has already been filed on behalf of the respondentState by way of the affidavit of Deputy Superintendent of Police, Dakha, Ludhiana Rural.

I have heard learned counsel for the petitioner as well as learned State counsel (assisted by learned counsel for the complainant) in POOJA SHARMA 2021.11.24 16:12 I attest to the accuracy of this order

CRM-M No. 21720 of 2021 -2the instant petition and have also perused the file thoroughly. Learned counsel for the petitioner contends that the petitioner is behind the bars since 05.03.2021 and is also not involved in any other criminal case of the similar nature and even otherwise, the only role attributed to him in the alleged occurrence, is that he caused injuries on the legs of the complainant with the iron pipe and moreover, the Challan has already been presented in the Court and in these circumstances, he (petitioner) deserves the relief as prayed for in this petition. Learned State counsel does not dispute the afore-referred factual position.

Keeping in view the above-discussed facts and circumstances as well as the fact that the trial of the case is likely to take sufficient time to conclude and without commenting or expressing any opinion on the merits of the case, the petitioner named Balwinder Singh is ordered to be released on regular bail subject to his furnishing the requisite personal and surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/ Duty Magistrate concerned.
