(Oral) The petition has been filed inter alia seeking a writ of mandamus directing the respondents to grant promotion to the petitioner from the post of JBT to that of Lecturer, and the benefit of Assured Career Progression (ACP) scales.

Learned State counsel has received instructions from the Department vide memo dated 16.02.2026, which is retained on the case file as Annexure 'A'. Referring to the same, he contends that the petitioner, who worked as JBT Teacher, was not entitled to promotion as Lecturer as there was no such channel of promotion under the service Rules. However, the due financial benefits as admissible, including the benefit of second Higher

-2Standard Scale with effect from 01.02.1999, were given to him. Relevant facts in this regard as mentioned in the instructions are the following: That the grievance of petitioner is that despite the fact that the JBT grade was given to the petitioner in the year 1979 itself, but the petitioner was not given the benefit of ACP after 10/20 years of service and also not given the benefit of Additional increment w.e.f. February 1979 and the culminating benefits onwards.

That after going through the present matter and relevant record pertains to the petitioner it is found that the petitioner was initially appointed on post of JBT teacher on dated 10.01.1979 in Pay scale 125-250 thereafter petitioner got J.S.T Grade (Master grade) w.e.f. 01.04.1979 with pay scale 220-400 on the basis of his B.A qualification. So the demand of petitioner qua 1st ACP w.e.f. 01.01.1994 is not admissible because the petitioner has already availed the J.S.T Grade (Master grade) w.e.f. 01.04.1979. Further the petitioner has demanded the 2nd ACP w.e.f. 01.02.1999. The petitioner has already got the benefit of Higher Standard Scale w.e.f. 01.02.1999 in Pay Scale 6500-9900 instead of Pay Scale 5500-9000.

The petitioner has also demanded Promotion to the post of Lecturer from the post of JBT teacher the same is not admissible as there are no channel for promotion from the post of JBT to Lecturer as per rules. Moreover the petitioner was promoted to the post of S.S Master w.e.f. 12.07.1995 with Financial benefits (i.e. One Increment). The matter of promotion of petitioner was returned by the department as he was not in term of promotion of lecturer because the Masters/C&V teachers, who were appointed till 16.09.1982, have been appointed whereas the petitioner was promoted as S.S. Master w.e.f. 12.07.1995.

Learned senior counsel is not in a position to dispute the facts aforementioned. Therefore, the petitioner's claim for promotion as well as first ACP scale cannot be accepted.

The petition accordingly stands dismissed.
