(ORAL) This is a petition that has been filed for issuance of a writ in the nature of mandamus directing the respondent Commission to award 4 marks of degree in Computer Science & Engineering and consider the claim of the petitioner for appointment to the post of Sub Inspector. Learned senior counsel for the petitioner would contend that the respondent Commission has recommended the name of the petitioner for appointment to the post of Sub Inspector and would further submit that since recommendation has been made, respondent No.3 be directed to issue him appointment letter. It is further submitted that the petitioner would not claim any arrears of pay, however, he should be given seniority as per his merit position over and above the persons, who are lower in merit than the petitioner.

In view of the aforementioned fact, nothing survives for consideration in the instant petition and the same is disposed of as having been rendered infructuous. However, respondent No.3 is directed to issue appointment letter to the petitioner and cast his seniority as per his merit position within a period of three weeks from the date of receipt of certified copy of this order.
