**** RITU BAHRI , J. (Oral) Petitioner is seeking quashing of impugned order dated 14.08.2018 (P-6) whereby the District Judge cum Educational Tribunal, Gurugram has dismissed the appeal cum claim settlement of the petitioner as well as order dated 25.09.2017 (P-3) whereby services of the appellant was terminated. Petitioner was appointed as Assistant Professor (Civil Engineering) on 08.08.2017. The services of the petitioner was terminated on 25.09.2017. the petitioner preferred an appeal before the Tribunal and the same was dismissed on 14.08.2018. A bare perusal of order dated 14.08.2018 shows that the petitioner joined the post on 08.08.2017 and on 24.09.2017, he himself handed over the charge of his duties to one Parveen. This handing over/taking over was signed by the petitioner.

Even No Dues certificate was issued to the petitioner, which was duly signed by him and experience certificate was also issued to him. Hence it was not a case of termination of service. It was a case where the petitioner himself had handed over charge to one Parveen. Learned counsel for the petitioner submits that there was no occasion with the petitioner to leave the job as he had joined on 08.08.2017 and he was being compelled to sign the handing over/taking over charge. CWP No. 13460-2019 The writ petition is dismissed as the petitioner has not led any evidence before the Tribunal that he was being compelled to sign the handing over/taking over charge to one Parveen. The petitioner has admitted that he had signed No Due certificate.
