Present petition under Section 482 Cr.P.C. for quashing of order dated 21.5.2015, passed by the learned Judicial Magistrate Ist Class, Kapurthala, whereby petitioner was declared as proclaimed offender. Learned counsel for the petitioner contended that petitioner was earlier admitted to bail and thereafter because of some medical problem, he could not appear before the Court below and his bail/surety bonds were cancelled.

Having considered these submissions that petitioner was actually admitted to bail and thereafter he remained away from the Court for the period of more than two years. However, petitioner can take all these pleas before the learned Court below regarding his illness, if any and the learned trial Court shall consider all the pleas.
