Admittedly, the order dated 12.10.2023, impugned herein, passed by the learned Single Judge, is based on the concession given by the present appellants that the dispute was covered by the judgment of the Apex Court. Appellant No.1 herein, who was respondent No.2 in the writ petition before the learned Single Judge, was duly represented. In fact, appellant No.2 (respondent No.3 before the learned Single Judge), was also represented by the same counsel. In such circumstances, having conceded before the learned Single Judge, the appeal cannot be maintained.
