IN THE HIGH COURT OF PUNJAB & HARYANA

AT CHANDIGARH CWP No. 9002 of 2020 (O&M) Date of Decision: 18.07.2022 Parmod Kumar .......... Petitioner

Versus

State of Punjab and others .......... Respondents CORAM: HON'BLE MR. JUSTICE MAHABIR SINGH SINDHU

Present:

Mr. Ishan Kaushal, Advocate, for the petitioner. Mrs. Anju Sharma Kaushik, Deputy Advocate General, Punjab for official respondent Nos. 1 to 3 / State.

Mr. Sarthak Gupta, Advocate for respondent No. 4.

Mr. Shreenath A. Khemka, Advocate for respondent No. 5.

**** MAHABIR SINGH SINDHU, J.

Present petition has been filed under Article 226 of the Constitution, inter alia, for issuance of a writ in the nature of certiorari to quash promotion order dated 04.10.2019 (P-20) and order dated 30.07.2019 (P-17).

Learned counsel, on instructions from petitioner, submits that instead of pressing the present petition on merits to challenge the promotion order of private respondent No. 4, he would be satisfied in case his requests dated 10.12.2021 & 08.02.2022 (P-23 & P-26 respectively) for promotion to the post of Superintendent Grade-I is considered by the competent authority expeditiously.

Learned State Counsel raises no objection to the aforesaid limited prayer.

CWP No. 9002 of 2020 (O&M) -2In view of the agreed stand taken by both sides, but without going into the merits of the controversy regarding promotion of private respondent No. 4, present writ petition is disposed off with a direction to official respondent(s) to consider his representation(s) and pass reasoned order within two months from the date of receipt of certified copy of this order.

It is made clear that in case there is a failure, the petitioner would be at liberty to move an appropriate application before the Nodal Officer concerned.

Pending application(s), if any, shall also stand(s) disposed off. July 18, 2022 ( MAHABIR SINGH SINDHU ) 'dk kamra'
