This petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.58 dated 12.2.2017 registered for the offences under Sections 148, 186, 323, 332, 353, 307, 427, 506 read with Section 149 IPC and Section 25 of the Arms Act at Police Station Hathin, District Palwal.
Notice of motion to Advocate General, Haryana. Mr. B.S. Virk, learned Deputy Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioner as well as learned Deputy Advocate General, Haryana appearing for the respondentHarpal Singh Parmar 2017.09.15 17:04 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-33427 of 2017 [2] State and have gone through the record.
From the record, I find that the present petitioner is named in the FIR. As per prosecution version, simple injuries are attributed to the petitioner. It is also argued by the learned State counsel that no injury has been declared grievous or dangerous to life.
The petitioner has been in custody since 28.4.2017. The petitioner, who is in judicial custody, is no more required for any interrogation and investigation purposes. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case.
Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
