******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 139 dated 16.09.2016 registered for the offences punishable under Sections 308, 323, 325, 506, 148 read with Section 149 of Indian Penal Code at Police Station Dasuya, District Hoshiarpur. Heard.
Learned State counsel submits that the occurrence took place on 14.09.2016, when the complainant along with Daljit Singh were going on motor cycle bearing No. PB-21-A-8442 towards their village. Petitioner, who was driving a car hit their motor cycle, as a result of which both of them fell on the ground and on the lalkara of Harcharan Singh, petitioner Jyoti 2017.11.08 13:39 I attest to the accuracy and authenticity of this document
CRM-M-33430-2017 -2along with other accused namely Davinder Singh, Lakhwinder Singh, Shally and Pamma caused injuries on the person of complainant and Daljit Singh with iron rods, handle of Kahi and dandas.
Complainant Kashmir Singh suffered five injuries out of which one was declared grievous while Daljit Singh suffered eight injuries out of which three were declared grievous in nature. Injury No. 8 on the frontal portion of the head of Daljit Singh was having fracture, as such offence punishable under Section 308 IPC was added in this case. Learned counsel for the petitioner submits that Harcharan Singh father of petitioner has been allowed bail in this case. Two injuries on the person of Daljit Singh and four injuries on the person of Kashmir Singh were punctured wound which could not be caused by weapons attributed to petitioner and his co-accused in the FIR.
On perusing the injuries suffered by the petitioner and seat of injuries as per pictorial diagram, I find that Daljit Singh had suffered injuries on the vital part while the complainant suffered injuries on both the legs and both the arms. One of the weapon allegedly in possession of petitioner and other accused was iron rod. The manner and the nature of the injuries do not call for exercising any discretionary power of this Court so as to extend the benefit of anticipatory bail to the petitioner. This petition has no merits.
Dismissed.
