**** HARNARESH SINGH GILL , J. (ORAL) Case is being taken up for hearing through video conferencing. The petitioner seeks regular bail in FIR No. 13 dated 11.2.2020 under Section 306 IPC registered at Police Station Hariana, District Hoshiarpur.

Learned counsel for the petitioner submits that petitioner is the husband of Monika Devi. Their marriage had been solemnized in the year 2009 and out of the said wedlock, two children were born. He further submits that neither there is any suicide note nor any complaint was made by the deceased at any stage as they had been living happily for the last 10 years.

Learned counsel for the petitioner further submits that moreover, both the children are with the grandmother i.e. the mother of the petitioner and the petitioner has been in custody since 11.2.2020. CRM-M No. 17380 of 2020 -2challan was presented on 09.4.2020 and the charges are yet to be framed. He has not disputed the fact that there is no suicide note in the present case. The petitioner has been in custody since 11.2.2020. Challan has been presented but the charges are yet to be framed. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
