Petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.01 dated 01.01.2016 under Section 22 of the NDPS Act, registered at Police Station Banga, District SBS Nagar.

Ms.Simranjeet Kaur, Asstt. Advocate General, Punjab, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that as per prosecution version, 125 grams of powder containing Diphenoxylate Hydrochloride has been recovered from the petitioner, which falls under commercial category. CRM No.M-33456 of 2017 -2petitioner. As per Section 37 of the NDPS Act, bail cannot be granted in the case of commercial quantity.
Therefore, finding no merit in the present petition, the same is dismissed.
