During the course of arguments, counsel for the petitioner informs that challan has not been presented in the present case. In view of the said circumstance, this court cannot form an opinion that there is no material available on the record regarding dishonest intention of the petitioner to cheat the complainant by persuading him to part with money, which is subject matter of the present FIR. Dismissed as pre-mature with liberty to the petitioner to approach this court again in case the prosecution agency opts to present challan against him.
