 !"#  $ Allegations against the petitioner Sher Singh @ Sheran in this petition filed under Section 439 Cr.P.C. seeking regular bail in case FIR No.401 dated 27.06.2015 registered at Police Station City Palwal, District Palwal under Sections 193/194/195A/196/211/120B/ 216/197/198/466/325/326/201 IPC and Section 13(1)(d) of P.C.  fabrication of injuries on payment of money and in such similar act had fabricated and manipulated injuries on the person of Tarif. Contentions of learned counsel for the petitioner Mr.G.C. Shahpuri, Advocate inter alia that the petitioner is in custody since 27.06.2015 and trial is not likely to conclude in near future and that co= accused Dr.Manish Kumar has already been granted regular bail vide order dated 21.09.2015 of this Court, could not be controverted by learned State counsel.

Without feeling necessity to advert onto the merits of the case, in view of the principle of parity and the fact that the petitioner is a Tempo driver neither employed in the hospital nor has much role in the light of the allegations, culpability if any shall be determined at the time of trial and the trial will take a long time to conclude. Thus, this Court is of the opinion that further detention of the petitioner in the present case is not warranted. Accordingly, he is ordered to be released on regular bail to the satisfaction of Chief Judicial Magistrate, Palwal.
