(ORAL) After arguing for sometime, learned counsel for the appellant seeks to withdraw the instant appeal with liberty to approach the trial Court for making an application for restoration of application filed by the appellant, seeking setting aside of ex-parte judgment/ decree dated 23.01.2019, which was dismissed vide order dated 24.01.2024 by the trial Court.

Dismissed as withdrawn with liberty aforesaid. In case, such an application, as aforesaid, is filed by the appellant, the trial Court shall consider the same and pass an appropriate order, in accordance with law. 3.
