By CRM no.2193 of 2021, an advancement of the date of hearing in the accompanying is sought by respondent no.2, i.e. the complainant in the FIR, with Mr. Vashist, learned counsel appearing for her, submitting that prior to the Covid-19 epidemic having set in, the matter was referred to mediation and consequently the hearing in the matter be advanced, with the parties directed to again appear before the learned Mediator.

In response to notice issued in this application, Mr. Neeraj Poswal, learned AAG, Haryana, appears for the respondent State, with Mr. Sagar Deswal, Advocate, appearing for the non-applicant petitioner. He does not deny the factual position with regard to the matter having been sent for mediation.

In view of the above, this application is allowed and the date of hearing in the accompanying petition is advanced to today itself on the statement of the parties.

202) CRM-M-16921 of 2019 -2CRM-M-16921 of 2019 Mr. Deswal however submits that in fact upon the report under Section 173 of the Cr.P.C. having been submitted to the competent court, with that court itself admitting the petitioner to bail under the provisions of Section 438 of the Cr.P.C., this petition has been rendered infructuous. In view of the above, this petition is disposed of as having been rendered infructuous but with the parties obviously at liberty to file an appropriate application before the learned trial court at Gurugram for allowing them to enter into mediation to try and settle the matter once and for all.
