The case has been taken up for hearing through video conferencing.

The petitioner has participated in the tendering process. The petitioner has not entered into agreement with the respondent department. The petitioner has primarily relied upon Clause 12 of the agreement. Needless to add that Clause 12 of the agreement would only be invoked if there was agreement entered into between the parties and case of the petitioner was also that she may not be blacklisted. However, it shall be open to the respondent department to take action in accordance with the terms and conditions of NIT. The petitioner was directed to enter into agreement within five days, which she has failed to do.
