(Oral) The petitioner through instant petition is seeking permission to recall the statement which the petitioner has made before the Additional Sessions Judge, Faridabad in FIR No.252 dated 18.11.2022 registered at Police Station Women NIT, Faridabad, under Sections 376(2)(n), 506 and 509 of IPC.

Learned counsel for the petitioner submits that the petitioner on the promise of marriage by accused made a statement before trial Court in favour of accused, however, he is not coming forward for marriage and family members of the accused are rather threatening. He further submits that trial Court may be directed to permit the petitioner to recall her statement.

Indubitably, the trial is pending before the Sessions Court and in view of pendency of the trial before the trial Court, this Court does not find it appropriate in any manner to ask the trial Court to permit the petitioner to recall her statement.
