The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to the respondents to make proper reference in terms of Industrial Disputes Act, 1947.

The petitioners are former workers of an industrial unit. They came to be retrenched. They filed demand notice and on their notice, reference was made to Labour Court. The said Court returned the reference to authorities to send proper reference. The said reference was made by authorities on 28.03.2023 and it was returned on 12.04.2023. Mr.Vipin Kumar submits that the authorities are not making proper reference to Labour Court despite expiry of more than one year from the date of return of reference by Labour Court. 4.

On the asking of Court, Mr. Maheshinder Singh Sidhu, Advocate could not advance plausible reason for not taking decision after receipt of reference by Labour Court.

Considering the issue involved and statement of both sides, I find it appropriate to direct the respondents No. l and 3 to consider the reason of returning of reference by Labour Court and take appropriate decision within 08 weeks from today.
