(Oral) The instant petition has been filed under Section 439 of the Code of Criminal Procedure for seeking regular bail to the petitioner in FIR No.36 dated 17.01.2021 registered under Section 379-B/34 of the Indian Penal Code and under Section 25 of Arms Act, (later on offence under Section 25 of Arms Act deleted) at Police Station City Tohana, District Fatehabad.

Learned counsel appearing on behalf of the petitioner contends that the instant FIR was registered against the petitioner and that the petitioner was already in custody in another case. He was nominated as an accused in this case and taken in custody on 11.02.2021. He submits that only recovery of mobile phone is shown to be effected from the petitioner. Learned State Counsel, on the other hand, has apprised the Court that the petitioner is involved in as many as seven other cases and that the trial is at fag end inasmuch as 14 out of 17 witnesses have been examined by the prosecution.
