**** JITENDRA CHAUHAN, J. (Oral) The matter has been taken up through video-conferencing in the light of the pandemic COVID-19 situation and as per instructions. The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 11 dated 21.01.2020 registered under Sections 406, 420 of Indian Penal Code at Police Station Pratap Nagar, District Yamuna Nagar. Heard.
On 06.07.2020, the following order was passed:- "The matter has been taken up through videoconferencing in the light of the pandemic COVID-19 situation and as per instructions.
Notice of motion for 05.08.2020.
At the asking of the Court, Mr. Apoorv Garg, DAG, Haryana,accepts notice.
The petitioner is directed to join the investigation. JYOTI 2020.09.10 23:52 I attest to the accuracy and integrity of this document Meanwhile, in the event of arrest of the petitioner by the
CRM-M-17284-2020 (O&M) -2Arresting Officer, he shall be released on interim bail subject to the following conditions:-
1. That he shall make himself available for interrogation by a police officer as and when required;
2. That he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer and;
3. That he shall not leave India without prior permission of the Court."
Learned State counsel on instructions from ASI Sukhdeep Singh submits that in pursuance of the order dated 06.07.2020 passed by this Court, the petitioner has joined the investigation and he is not required for custodial interrogation.
In view of the above, without expressing any opinion on the merits of the case, the interim bail granted by this Court vide order dated 06.07.2020 is made absolute, subject to furnishing bail bonds/surety bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate concerned.
