Through this petition under Section 439 Cr.P.C., petitionerRamesh Kumar Paswan @ Lambu, has prayed for grant of regular bail in case FIR No. 142 dated 09.06.2018 registered under Sections 379, 380, 411, 413, 457 and 473/34 IPC at Police Station Meharban, District Ludhiana. 2.

According to the prosecution, the petitioner and his accomplice are habitual thieves. They commit theft in the night hours in the locked houses. They were apprehended on 09.06.2018 by ASI Amrik Singh, CIA-I Ludhiana, by laying a barrier at 'T' point, village Serra, Rahon Road, Ludhiana, on the basis of secret information. 3.

Learned counsel for the petitioner inter alia contends that co-accused of the petitioner, namely; Rakesh Kumar @ Ladi, has been enlarged on bail by the learned Additional Sessions Judge, Ludhiana vide order dated 24.07.2018 (Annexure P-3). The petitioner is in custody since 09.06.2018. No recovery has to be effected from him. Conclusion of trial may take a long time. On the other hand, learned State counsel vehemently opposed the submissions made by learned counsel for the petitioner. 5.

Considering over-all facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner-Ramesh Kumar Paswan @ Lambu, is ordered to be released on bail pending trial, treating his case on the same parity as that of his co-accused, namely; Rakesh Kumar @ Ladi, on his furnishing appropriate bail bonds and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
