On 24.3.2026, the following order was passed: 'Apprehending his arrest in FIR No.199 dated 27.05.2025 registered for offences punishable under Sections 318(4), 319(2), 351(3), 61(2), 338, 336(3), 340(2) of the BNS, 2023 read i.e. 420, 406, 419, 506, 120-B, 467, 468,471 of IPC, at Police Station Sadar Fatehabad, District Fatehabad, the petitioner has preferred this 2nd petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 read i.e. 438 Cr.P.C. seeking pre-arrest bail.

Learned counsel for the petitioner, inter alia, contends that the first plea for anticipatory bail was withdrawn on 16.03.2026 with liberty to file afresh with complete/better particulars, the instant plea is the second attempt by the petitioner to seek anticipatory bail, primarily, on the basis of compromise having been effected between the parties and the terms thereof have been reduced into compromise-deed dated 10.03.2026 (copy whereof has been appended as Annexure P-7) & willing to join investigation and cooperate therein.

Notice of motion.

CRM-M No.15638 of 2026 -2On the strength of advance notice, Ms. Mahima Yashpal, Sr. DAG, Haryana, causes appearance on behalf of the respondent-State. At this juncture, Ms. Harpreet Kaur, Advocate, has caused CRM-M appearance on behalf of the complainant and has ratified the aspect of matter having been settled between the parties. Adjourned to 22.04.2026.

State is at liberty to file reply, if so required. The petitioner is directed to appear before the Investigating Officer on 27.03.20-26 at 11:00 A.M. in concerned Police Station and join investigation. In the event of arrest, the petitioner shall be released on interim bail subject to his furnishing personal/surety bond(s) to the satisfaction of the Arresting Officer/Investigating Officer. As and when further called by Investigating Officer, the petitioner shall join the investigation. He shall abide by the condition(s) enumerated under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.' 2.

Learned State counsel (on instructions) submits that pursuant to the order dated 24.3.2026, the petitioner has joined investigation and is no longer required for custodial interrogation.

In view of the above, the instant petition is allowed. Interim order dated 24.3.2026, passed by this Court is made absolute, subject to the conditions as enumerated under Section 482(2) of BNSS. 4.

This order should not be treated as "blanket" order. It will not be read granting petitioner indefinite protection from arrest. It shall be confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence. 5.

Liberty is reserved in favour of State/complainant to move for cancellation/recall of this order in case the petitioner violates any condition stipulated under Section 482(2) of BNSS or upon showing any other sufficient cause.
