Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.46 dated 02.05.2018, registered under Sections 279, 337, 338 and 427 IPC at Police Station Phase 11, District SAS Nagar, Mohali (P-1) and all subsequent proceedings arising therefrom, on the basis of compromise (P-2).
Pursuant to order dated 11.04.2019 of this Court, the parties appeared before the trial Court on 18.05.2019 along with photocopy of receipt of `15,000/- to get their statements recorded. Learned Additional SONIKA 2019.05.27 18:08 I attest to the accuracy and authenticity of this document Chandigarh
CRM-M-16813 of 2019 --2-- Chief Judicial Magistrate, SAS Nagar (Mohali), has submitted his report vide letter bearing No.78 dated 21.05.2019, duly forwarded by learned District and Sessions Judge, SAS Nagar, vide Endst. No.6225 dated 22.05.2019.
According to the report, ld. Additional Chief Judicial Magistrate, SAS Nagar (Mohali), is satisfied that compromise appears to be genuine. No accused has been declared as proclaimed offender. Considering the report of ld. Additional Chief Judicial Magistrate, SAS Nagar (Mohali), dated 21.05.2019 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.46 dated 02.05.2018 along with all subsequent proceedings arising therefrom, is quashed qua the petitioner only. Disposed of accordingly.
