Mr. Sandeep Godara, Advocate, for the petitioner. ***** Rajan Gupta, J. (Oral) Petitioner was recruited as a constable in Indian Reserve Battalion of Punjab Police in the year 1990. In the year, 2006, he remained absent from duty for 61 days without any sanctioned leave/permission. A regular departmental enquiry was ordered against him. Admittedly, petitioner did not associate with the enquiry proceedings. On the basis of enquiry report, the disciplinary authority vide order dated 02.09.2006 dismissed the petitioner from service. The order was unsuccessfully challenged by the petitioner in appeal/revision. The revision petition was dismissed on 25.01.2008. Petitioner, thereafter, remained silent. He claimed to have filed a mercy petition in July, 2013.

In considered view of this court, no case for interference in writ jurisdiction is made out. The petition is frivolous and suffers from serious laches. Besides, no plausible explanation is forthcoming for absence of the petitioner from duty and not associating with the enquiry proceedings. Petition is without any merit and is hereby dismissed.
