(ORAL) This Letters Patent Appeal has been filed by the State against the judgment of the learned Single Judge dated 28.02.2002 entitling the respondents-employees to the benefit of one increment on account of promotion from the posts of JBT Teachers to Masters. In some of the connected matters pertaining to similar controversy, the issue was taken before the Hon'ble Supreme Court, which has set aside the impugned judgment before it by holding that such employees, who have been promoted from the posts of JBT Teachers to Masters are not entitled to any increment but did not disturb the benefits already given.

Learned counsel for the respondents fairly concedes that the issue has been decided against them and prays that the LPA be disposed of VIRENDRA SINGH ADHIKARI 2016.05.26 14:58 I attest to the accuracy and authenticity of this document High Court Chandigarh in same terms but the benefit granted earlier be protected as has been done

L.P.A. No.390 of 2003 (O&M) -2in the cases of similarly situated employees before the Hon'ble Supreme Court of India, in the case titled as State of Haryana and another Vs. Partap Singh and others, 2006(6) SLR 21.

Upon hearing learned counsel for the parties, we find that the instant appeal is squarely covered by the ratio of aforesaid judgment. Consequently, the appeal is disposed of in terms of the abovesaid judgment rendered by the Hon'ble Supreme Court.
