M.M.S. BEDI, J (ORAL) Petitioner seeks concession of regular bail in a case registered against number of persons on the basis of secret information that as members of a gang they use to supply heroin, smack, opium and other intoxicants to students of educational institutions.

So far as the petitioner is concerned, he was involved in the case on the basis of statement of his co-accused Ajay Jain. No recovery was effected from said Ajay Jain. Challan has already been presented. It is also an admitted fact that no recovery was effected from the petitioner.

In view of said circumstance, culpability of the petitioner will certainly be a debatable issue. The petition is allowed. It is ordered that the petitioner will be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the trial Court. (M.M.S. BEDI) February 23, 2015.
