The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to re-issue his passport.

Cost, as imposed vide order dated 10.04.2023, stands paid. 3.

The petitioner was issued passport on 13.04.2011 which expired on 12.04.2021. The petitioner, in 2020, left the country. The petitioner since then is staying in Portugal on work permit. The petitioner was interested to settle in Germany, however, German Government rejected request of the petitioner for asylum and asked the Indian authorities to take the petitioner back. The petitioner, at present, is not staying in Germany and as per petitioner, he is having work permit of Portugal. Learned counsel for the petitioner submits that petitioner has applied for re-issuance of passport and application of the petitioner ispending with respondent authorities since January' 2022. The respondents have not adjudicated application of the petitioner. No criminal or civil case is pending against the petitioner. There is no provision in the Passport Act which prohibits issuance of passport to the petitioner. 5.

Learned counsel for Union of India assures the Court that competent authority would look into application of the petitioner and pass a speaking order within six weeks from today.

In the wake of statement of learned counsel for Union of India, the petition stands disposed of. The passport authority would treat the present petition as representation of the petitioner. The passport authority is free to seek documents from petitioner as are necessary for the disposal of application seeking passport.
