3. Whether the judgment should be reported in the Digest? AJAY TEWARI, J (ORAL) Prayer is for grant of regular bail in case FIR No.55 dated 01.02.2015 under Sections 186,353,379,188,307 IPC, P.S Sadar Palwal, District Palwal.
Allegations against the petitioner are that eight to ten Dumpers were illegally mining sand and on being apprehended, the driver tried to run over the police staff.
Learned counsel for the petitioner argues that the petitioner is not the owner of the offending vehicle nor is he named in the FIR, therefore, the provision of Section 307 IPC are not attracted to his case. It is stated that the petitioner has been in custody for about one month and twenty days. Aforesaid facts have been accepted by the learned State counsel.
Without commenting upon the merits of the case and taking
CRM-M- 33657 of 2015 (O&M) #2# into account the facts and circumstances of the present case and the fact that the trial is not likely to be concluded in near future, no useful purpose would be served by keeping the petitioner behind the bars any further. Accordingly, he is ordered to be released on bail to the satisfaction of the CJM/Duty Magistrate, Palwal.
Petition stands allowed.
