The present petition has been filed under Section 482 BNSS, 2023, for grant of anticipatory bail to the petitioner in case FIR No.06, dated 26.02.2026, under Sections 13(1)(A) read with 13(2) of PC Act, 1988 as amended by PC (Amendment) Act, 2018 and 61(2), 316, 336(2), 337, 338, 340(2) BNS, registered at Police Station Vigilance Bureau, Bathinda. 2.
On 17.04.2026, this Court had passed the following order:- "Learned counsel submits that the petitioner while working as a Secretary, though required to get the fertilizer lifted from the premises of the society, however, got it supplied to 8 members of the society from the godown of commission agent/co-accused Ramesh Kumar, which he states is an irregularity and not illegality, particularly in wake of the fact that the said 8 persons, opted to give the cheques of entire amount to him, which were got deposited with the concerned bank as per Annexure P-2, duly received under signatures and even as per statement of one Manpreet Kaur, working as a Clerk-cum-Data Entry Operator in the said Central Cooperative Bank.
There is no difference between the amount deposited, had it been sold from premises of society or commission agent and no loss caused to the society and no gain to him. For the last 30 years, he has worked in the Society, however, there has been no complaint whatsoever. He on account of the FIR, stands dismissed from service on 28.02.2025, against which an appeal has been filed. The petitioner is ready and willing to join the investigation as and when required by the investigating agency and will cooperate.

Meanwhile, the petitioner is directed to join the investigation on or before 24.04.2026. In the event of his arrest, he shall be released on interim bail to the satisfaction of the Arresting Officer, subject to compliance of conditions as enshrined under Section 482 (2) BNSS.
However, it is clarified that if the petitioner does not join and cooperate with the Investigating Agency as required by the Arresting/Investigating Officer, this interim order shall be deemed to have been vacated.

Learned counsel submits that in pursuance of the afore-mentioned order, the petitioner has not only joined investigation but also fully cooperated with the investigating agency. He further submits that in case the investigating agency requires the petitioner to appear, he shall make himself available without demur.

Learned State counsel on instructions from the Investigating Officer affirms the factum of joining the investigation by the petitioner and cooperating with the investigating agency. She also submits that at this stage, the petitioner is not required for further custodial interrogation. 5.
In view of the above and without expressing any opinion on the merits of the case, anticipatory bail petition filed by the petitioner is allowed and the order dated 17.04.2026 granting interim bail to him, is hereby made absolute, subject to compliance of conditions as specified under Section 482(2) of BNSS, 2023.

However, it is made clear that if the petitioner fails to join and cooperate with the investigating agency as and when required, the State would be at liberty to move an application for cancellation of the present anticipatory bail granted to him.
