Notice was issued to the sole appellant. The same has been received back duly served but the learned counsel for the appellant submitted that still the appellant is not in touch with him and he is not in a position to assist the Court. The appeal is pending since 1999. 2.
In view of the above and given the prevailing circumstances, there seems to be no justification to keep the appeal on the docket, indefinitely. Accordingly, the instant appeal stands dismissed for want of prosecution with liberty to the appellant to revive the same, if have any grievance from this order, within a period of three months from today. 3.
Since the main appeal stands decided, the miscellaneous application(s), if any, stand disposed of accordingly.
