******* SURINDER GUPTA, J.(Oral) Learned State counsel submits that in case bearing FIR No. 118 dated 09.06.2016, two out of five named accused have been found innocent, two have been arrested and against fifth proceedings to declare him proclaimed offender have been initiated. In cross-version case, petitioner was also an accused but he has died and other accused could not be apprehended and against him also proceedings to declare him proclaimed offender have been initiated.

In view of submission of learned State counsel, learned counsel for the petitioner seeks permission to withdraw the instant petition. Dismissed as withdrawn.
