PANKAJ JAIN, J. (ORAL) On 18.04.2023, the following order was passed :- "Learned counsel for the petitioner inter alia contends that the petitioner has been falsely implicated in the FIR No. 25 dated 15.03.2023 under Section 420 IPC registered at Police Station Sandaur, District Sangrur (now Malerkotla) (Annexure P-1) and the dispute is purely civil in nature. He further submits that the petitioner had filed the civil suit (Annexure P-2) wherein DSP Incharge Special Branch, Malerkotla had been arrayed as defendant No.3, however, the same DSP conducted the enquiry on the complaint culminating into registration of the aforesaid FIR.

Notice of motion.

On the asking of the Court, Mr. Shubham Kaushik, AAG, Punjab who is present in Court accepts notice on behalf of the respondent/State and prays for time to file reply/status report. Reply/status report to petition be filed within a period of 04 weeks with an advance copy to the counsel opposite. List on 18.07.2023.

In the meantime, petitioner is directed to join DEEPAK KUMAR 2023.08.10 09:18 I attest to the accuracy and integrity of this document

He will not leave the country without prior permission of the Court nor shall make any attempt to contact the complainant of the case or any witness associated with the case. In the event of the arrest of the petitioner, he shall be released on interim bail on his furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. He shall also abide by conditions as envisaged under Section 438(2) Cr.P.C."

Today, Ld. State Counsel on instructions from HC Rupinder Singh submits that the petitioner has already joined investigation and is no more required for custodial interrogation.

Without commenting on the merits of the case and in view of the aforesaid fact, order dated 18.04.2023 is made absolute, subject to the conditions as enumerated under Sections 438(2) Cr.P.C. 4.

The petitions stands disposed off.
